These Terms & Conditions explain the rules, policies, and expectations for using PopStickerMerch and purchasing products or services from our shop. By visiting popstickermerch.com, submitting artwork, approving a proof, or placing an order, you agree to these Terms.

1) Acceptance of Terms

These Terms & Conditions constitute an agreement between you and PopStickerMerch LLC (“PopStickerMerch,” “we,” “us,” or “our”). “You” and “your” refer to the person or business accessing our website, submitting content, or purchasing our products or services.

By accessing our website, submitting an order, uploading artwork, approving a proof, or purchasing from PopStickerMerch, you agree to these Terms and any additional policies referenced on our website.

If you do not agree with these Terms, please do not use our website or purchase our products or services.

2) Eligibility & Authority

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to place an order without the involvement of a parent or legal guardian.

If you place an order on behalf of a business, organization, school, nonprofit, government entity, or another person, you represent that you have authority to act on that party’s behalf and to accept these Terms for them.

You agree to provide accurate, complete, and current contact, billing, payment, artwork, and shipping information.

3) About Our Products

PopStickerMerch sells stickers, decals, labels, prints, custom-printed products, and related merchandise. Our products are printed, laminated, cut, packaged, or otherwise produced in-house.

  • Product features, materials, finishes, sizes, durability, and recommended uses may vary by product.
  • Product descriptions are provided for general informational purposes and may be updated as our materials or production processes change.
  • Waterproof, weather-resistant, dishwasher-safe, removable, or durability statements apply only under normal intended use and are not guarantees against every surface, environment, cleaning product, temperature, or application method.
  • Unless a product listing states otherwise, dishwasher-safe claims refer to top-rack dishwasher use. Hand washing is recommended for the longest possible product life.

4) Orders, Pricing & Payment

Placing an order

Orders must be placed through our website unless a separate written arrangement has been made for a custom, wholesale, business, school, nonprofit, or government order.

An order confirmation does not necessarily mean that an order has been accepted for production. We may review artwork, order details, payment information, material availability, and production requirements before accepting an order.

Pricing

Prices are displayed in U.S. dollars unless otherwise stated. Prices, product availability, promotions, quantities, specifications, and shipping options may change without notice.

We reserve the right to correct pricing, listing, coupon, inventory, or calculation errors. If an error affects an order already placed, we may contact you with the option to approve the corrected amount or cancel the affected order for a refund.

Payment authorization

Payment is required before production or shipment unless we have expressly agreed to different written payment terms.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the amounts associated with your order, including applicable taxes and shipping charges.

Taxes and tax-exempt purchases

Applicable sales tax may be collected as required by law. Customers requesting tax-exempt treatment must provide valid and complete exemption documentation before the applicable transaction is finalized.

Order accuracy

You are responsible for reviewing and confirming all order details, including product, size, quantity, material, finish, artwork, spelling, shipping address, and contact information.

We are not responsible for delays, losses, or additional costs resulting from inaccurate or incomplete information supplied by the customer.

5) Order Changes & Cancellations

Because many products are made to order, cancellation or modification is not guaranteed after an order has been submitted.

  • Standard merchandise orders may be changed or canceled only if fulfillment has not begun.
  • Custom orders cannot be changed or canceled after a proof has been approved or production has started.
  • Rush fees, design fees, setup fees, proofing fees, and other services already performed may be nonrefundable.
  • Approved cancellations may be subject to deductions for work already completed, materials ordered, payment-processing costs, or other nonrecoverable expenses.

To request a change or cancellation, contact sales@popstickermerch.com as quickly as possible. A request is not approved until we confirm it in writing.

6) Production Times

Unless a product listing, quote, or written agreement states otherwise, our typical processing time is approximately 3–5 business days, excluding weekends and holidays.

Production and delivery timeframes are estimates, not guaranteed completion or arrival dates.

Production may take longer because of order volume, proofing delays, customer-requested changes, material availability, equipment maintenance, complex artwork, specialty finishing, payment issues, weather, carrier disruptions, or other circumstances.

Production time begins only after all required information, usable artwork, payment, and proof approval have been received.

A shipping upgrade changes the carrier’s transit service. It does not automatically shorten production time unless rush production has been expressly purchased and confirmed.

7) Shipping & Delivery

U.S. shipping

  • Qualifying orders under $35: May ship free through USPS letter mail or another economical service that does not include tracking.
  • Qualifying orders of $35 or more: May be upgraded to tracked shipping through USPS Ground Advantage, Priority Mail, or another suitable service.

Available methods, thresholds, rates, and carriers may vary by product, destination, promotion, package size, or order value. The shipping option shown at checkout or on an accepted quote controls.

Shipping estimates

Carrier transit times are estimates and begin after the carrier accepts the package. They do not include production time.

Once an order has been transferred to a carrier, transportation, routing, scanning, and delivery are primarily controlled by that carrier. PopStickerMerch cannot guarantee a carrier’s delivery date or prevent every delay, loss, theft, misdelivery, or scanning error.

Shipping addresses

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for orders sent to an address supplied incorrectly by the customer.

If a package is returned because of an incorrect, incomplete, refused, or undeliverable address, the customer may be responsible for additional postage before the order is shipped again.

Package forwarding and reshipping services

Our responsibility ends when an order is delivered to the address provided at checkout. We are not responsible for loss or damage occurring after delivery to a freight forwarder, package forwarding company, hotel, mailroom, commercial receiving service, or other third-party recipient.

8) Delivery Issues

Untracked mail

If an untracked order has not arrived, contact us after at least 10 calendar days have passed from the date of the emailed shipping notice.

Because untracked letter mail does not provide carrier scans or a delivery record, we may ask you to confirm the shipping address and allow additional time for delivery before determining an appropriate resolution.

Tracked packages marked delivered

Carriers sometimes scan packages as delivered before they are physically received. If tracking shows delivery but the package is not in hand:

  • Verify that the shipping address is correct.
  • Check the mailbox, porch, garage, side doors, and other delivery areas.
  • Ask household members, neighbors, building staff, or a mailroom.
  • Contact the carrier or local post office when appropriate.
  • Allow up to seven calendar days for a premature scan to resolve.

After completing those steps, email sales@popstickermerch.com and we will help review the available information.

Lost, stolen, or damaged shipments

Any replacement, refund, carrier claim, or other resolution will be evaluated based on the shipping method, tracking, carrier findings, photographs, order value, and circumstances.

We may require the customer’s cooperation with a carrier investigation, missing-mail search, insurance claim, police report, or theft report before issuing a replacement or refund.

9) International Orders

International delivery times vary and may take 2–4 weeks or longer, depending on destination, carrier processing, customs review, and local postal operations.

  • Customers are responsible for customs duties, import taxes, brokerage charges, VAT, tariffs, and other destination-country fees.
  • Customs charges are not included unless expressly stated during checkout.
  • We cannot mark an order as a gift or intentionally misstate its value or contents.
  • Customers are responsible for confirming that ordered products may be legally imported into their destination.
  • We are not responsible for customs delays, inspections, seizures, refusals, or other actions taken by government or border authorities.

If an international order is returned because fees were unpaid, delivery was refused, or the address was incorrect, any approved refund may exclude original shipping charges, return charges, customs fees, and costs already incurred.

10) Returns, Replacements & Refunds

Because many of our products are made to order, printed in limited quantities, or personalized, all sales are generally final unless otherwise stated in a product listing or required by law.

We want customers to receive what they ordered. If an order arrives materially damaged, defective, or incorrect because of an error by PopStickerMerch, contact us within the claim period described below.

Possible resolutions

Depending on the circumstances, we may provide:

  • A replacement of the affected item;
  • A reprint of the affected quantity;
  • Store credit;
  • A partial refund;
  • A full refund for the affected item; or
  • Another reasonable resolution.

The appropriate resolution will be determined by PopStickerMerch based on the nature and extent of the verified problem. A replacement or reprint may be offered instead of a refund.

Items that generally do not qualify

Unless required by law, returns, refunds, or free reprints are generally not available for:

  • Buyer’s remorse or a change of mind;
  • Incorrect products, sizes, quantities, or options selected by the customer;
  • Incorrect or incomplete shipping information supplied by the customer;
  • Approved spelling, grammar, layout, sizing, or artwork errors;
  • Low-resolution, pixelated, or otherwise unsuitable customer artwork;
  • Normal color, finish, size, cut, or quantity tolerances;
  • Damage caused by improper storage, cleaning, application, or use;
  • Products applied to incompatible, dirty, textured, coated, or damaged surfaces;
  • Damage occurring after delivery;
  • Ordinary wear and tear; or
  • Delays caused by carriers, customs, weather, or circumstances outside our control.

Return authorization

Do not mail products back unless we provide written return instructions. Unauthorized returns may not be accepted or refunded.

11) Order Inspection & Claims

Customers must inspect an order promptly after delivery.

Claims involving damage, defects, shortages, or incorrect items must be reported within seven calendar days of delivery, unless a longer period is required by applicable law.

A claim should include:

  • The order number;
  • A description of the issue;
  • Clear photographs of the affected product;
  • A photograph of the full quantity received when quantity is disputed;
  • Photographs of the packaging and shipping label when damage occurred in transit; and
  • Any other information reasonably needed to evaluate the claim.

Please retain the affected products and packaging until the claim is resolved. Discarding products before we can review them may prevent us from verifying the issue.

Failure to report a visible issue within the claim period may result in the order being considered accepted, to the extent permitted by law.

12) Custom Printing Services

PopStickerMerch is primarily a printing and production service. Unless separately purchased or expressly agreed to in writing, custom-print orders do not include:

  • Logo creation;
  • Original illustration;
  • Graphic design;
  • Artwork recreation or vectorization;
  • Photo retouching;
  • Copywriting or proofreading;
  • Trademark or copyright clearance;
  • Color-separation services;
  • Extensive file repair; or
  • Legal review of submitted content.

Minor production adjustments, such as adding a cut line, resizing a supplied design, preparing bleed, or arranging artwork for production, do not mean that PopStickerMerch has reviewed or approved the artwork’s spelling, accuracy, quality, ownership, legality, or commercial suitability.

Any additional design or file-preparation services may require a separate fee and written approval.

13) Artwork Submission

Customer-supplied artwork is generally printed as submitted.

You are responsible for providing production-ready artwork that is accurate, complete, and suitable for the product ordered.

File quality

Low-resolution, blurry, pixelated, compressed, incorrectly sized, or improperly prepared artwork may produce lower-quality results. Enlarging a small image does not add detail or improve resolution.

We may notify you if an obvious file-quality problem is identified, but we are not required to detect or correct every issue.

Fonts, links, transparency, and effects

Customers are responsible for ensuring that fonts are embedded or converted to outlines, linked images are included, transparency and effects are properly prepared, and all intended elements appear in the submitted file.

Bleed and cut lines

Artwork may require bleed, spacing, borders, or other production allowances. Thin borders and designs with tight edge spacing may show normal variation more noticeably.

Cut lines may be adjusted for production safety, durability, machine compatibility, or minimum spacing requirements.

14) Proofs, Revisions & Approval

For certain custom orders, PopStickerMerch may provide a digital proof before production. A proof is intended to show the expected layout, general size, artwork placement, and cut line.

Digital proof limitations

A digital proof is not a physical sample and is not an exact representation of final color, texture, finish, material, reflectivity, transparency, metallic effects, holographic effects, or scale on every device.

Proofs should not be used as a guarantee of exact screen-to-print color.

Customer review responsibilities

Before approval, the customer must carefully review all details, including:

  • Spelling and grammar;
  • Names, dates, phone numbers, addresses, and URLs;
  • Prices, ingredients, warnings, instructions, and legal statements;
  • Artwork orientation and placement;
  • Product dimensions and quantity;
  • Cut line shape and placement;
  • Margins, bleed, borders, and spacing;
  • Image quality and resolution; and
  • Any other customer-supplied information.

Approval authorization

By approving or signing a proof, the customer:

  • Confirms that the proof is correct;
  • Accepts responsibility for the approved content;
  • Authorizes PopStickerMerch to begin production; and
  • Understands that further changes may not be possible.

PopStickerMerch is not responsible for typographical, layout, sizing, artwork, or other customer-approved errors after proof approval.

Revisions

Unless a quote or product listing states otherwise, proof revisions are intended for reasonable production-related adjustments.

Replacing the original artwork, changing the overall concept, requesting design work, rebuilding a file, or making extensive edits may require an additional fee or a new order.

Proof approval delays may affect the original estimated production and delivery schedule.

15) Unapproved & Abandoned Proofs

We may contact customers through the email address or other contact information provided with the order. Customers are responsible for monitoring those communications and responding to proof requests.

If a custom order remains awaiting artwork, information, revisions, or proof approval for more than 30 calendar days, we may place the order on hold, archive it, or cancel it.

Any refund for an abandoned order may be reduced by design work, proofing, setup work, payment-processing charges, specialty materials, or other costs already incurred.

Production availability and pricing may need to be reviewed again if the customer returns after an extended period.

16) Color, Material & Product Variations

Screens and printed products use different color systems. Screens generally display color using RGB light, while commercial printing uses inks and printable color profiles.

Color appearance can vary because of:

  • Monitor brightness and calibration;
  • Phone, tablet, and computer display settings;
  • RGB-to-print color conversion;
  • Artwork color profiles;
  • Ink, laminate, and material batches;
  • White, clear, holographic, metallic, or specialty substrates;
  • Ambient lighting;
  • Surface color beneath transparent materials; and
  • Normal production variation.

Unless a separately purchased and confirmed color-matching service is provided, we do not guarantee exact Pantone, brand, screen, previous-order, office-printer, or competitor-sample color matching.

Reorders may differ slightly from earlier production runs because of changes in material lots, ink, laminate, equipment settings, environmental conditions, or supplier manufacturing.

Slight color, opacity, texture, gloss, finish, or material variation is normal and is not considered a defect.

17) Manufacturing Tolerances

Custom printing and finishing involve mechanical and material processes. Minor variations are unavoidable and are accepted as normal manufacturing tolerances.

Unless a stricter tolerance is expressly agreed to in writing before the order is placed, reasonable variations may occur in:

  • Color and ink density;
  • Cut position and registration;
  • Finished dimensions;
  • Border thickness;
  • Print placement;
  • Material thickness and texture;
  • Laminate placement;
  • Finish and gloss level;
  • Sheet or roll alignment;
  • Packaging arrangement; and
  • Final quantity.

Cut and size tolerance

Small shifts in cut position or finished dimensions may occur. These shifts can be more noticeable on designs containing thin, even borders or artwork positioned very close to the cut line.

Quantity accuracy

PopStickerMerch supplies the quantity ordered. We carefully count and verify custom, bulk, and wholesale orders before they are packaged for shipment.

If you believe your order contains a quantity shortage, please contact us within seven calendar days of delivery and include your order number, a description of the issue, and a photograph showing the full quantity received.

After reviewing the claim, PopStickerMerch may replace the verified missing quantity or provide another appropriate resolution.

18) Product Use & Application

Customers are responsible for determining whether a product is appropriate for their intended surface, environment, application, and use.

Adhesion and removability can vary depending on:

  • Surface texture and coating;
  • Paint condition and age;
  • Cleanliness and surface preparation;
  • Temperature and humidity;
  • Exposure to sunlight, water, chemicals, oils, or abrasion;
  • Application pressure and technique; and
  • Length of time the product remains applied.

Before applying a product to a valuable, painted, delicate, antique, powder-coated, porous, textured, or unfamiliar surface, test it in a small, inconspicuous area.

PopStickerMerch is not responsible for surface damage, residue, staining, discoloration, coating changes, or other results caused by application, removal, cleaning, environmental exposure, or incompatible surfaces.

Our products are not intended as safety equipment, regulatory labels, permanent identification systems, or substitutes for legally required warnings unless expressly stated in writing.

19) Order Acceptance & Restricted Content

We reserve the right to review, refuse, suspend, or cancel any order for a lawful reason, including production limitations, suspected fraud, intellectual-property concerns, abusive conduct, safety concerns, or content that is inconsistent with our policies or brand.

PopStickerMerch does not produce or distribute custom content that includes or is primarily focused on:

  • Political campaigns, candidates, or political messaging;
  • Current divisive social or political issues;
  • Hate speech, harassment, bullying, or discriminatory material;
  • Threats, intimidation, or encouragement of harm;
  • Graphic violence or extreme gore;
  • Explicit sexual or pornographic content;
  • Illegal products, conduct, or instructions;
  • Fraudulent, deceptive, or impersonating material;
  • Content that violates privacy, publicity, or personal rights;
  • Copyright, trademark, trade dress, or other intellectual-property infringement;
  • Content that could expose PopStickerMerch to legal liability; or
  • Other material that we determine we cannot safely, lawfully, or appropriately produce.

This list is not exhaustive. Acceptance of one order does not require us to accept a similar order in the future.

If we cancel an order before production because it violates this policy, we may issue a refund less any nonrecoverable costs or services already performed, where permitted by law.

20) Customer Artwork & Intellectual Property

Customer ownership

As between you and PopStickerMerch, you retain any ownership rights you legally hold in the original artwork, logo, photograph, text, or other content you submit.

Limited production license

By submitting content, you grant PopStickerMerch a limited, non-exclusive, royalty-free license to access, store, reproduce, resize, crop, arrange, prepare, print, manufacture, package, and display the submitted content only as reasonably necessary to:

  • Prepare proofs;
  • Communicate with you about the order;
  • Perform production and quality-control activities;
  • Manufacture and fulfill the order;
  • Resolve customer-service, payment, shipping, or legal issues; and
  • Maintain reasonable business and transaction records.

PopStickerMerch will not sell or license customer-supplied artwork to third parties as standalone artwork.

We will not use customer-supplied artwork in public advertising, social media, portfolio displays, product listings, or promotional materials without permission, except where the customer has independently made the content public and has expressly authorized our use.

Customer representations and warranties

By submitting content, you represent and warrant that:

  • You own the content or have all permissions needed to use and reproduce it;
  • You have permission to use all included names, logos, photographs, likenesses, trademarks, and copyrighted elements;
  • The content does not infringe or misappropriate another party’s rights;
  • The content does not violate privacy, publicity, confidentiality, contract, or other legal rights;
  • The content and intended product are lawful; and
  • Our production of the order according to your instructions will not violate applicable law or third-party rights.

PopStickerMerch does not provide copyright, trademark, licensing, or other legal-clearance services. Our acceptance or production of an order is not a legal determination that the submitted content is authorized or noninfringing.

21) PopStickerMerch Intellectual Property

Unless otherwise stated, our website content, branding, logos, product photography, original illustrations, graphics, copy, layouts, templates, production methods, mockups, and designs are owned by or licensed to PopStickerMerch and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, trace, distribute, sell, license, scrape, publish, or commercially exploit our content without prior written permission.

Purchasing a physical product does not transfer copyright, trademark, commercial reproduction rights, digital files, or ownership of the underlying design unless expressly stated in writing.

PopStickerMerch-created artwork

If PopStickerMerch creates or modifies artwork for a customer, ownership and usage rights will be governed by the applicable product listing, quote, or written agreement.

Unless expressly included, payment for printed products does not automatically include editable source files, layered files, production files, fonts, templates, working files, or exclusive rights.

22) AI-Generated or AI-Assisted Artwork

Customers may submit artwork created or modified using artificial intelligence, machine-learning systems, or generative tools.

The customer remains fully responsible for confirming that the submitted artwork may legally be used, reproduced, and sold.

PopStickerMerch does not guarantee that AI-generated or AI-assisted artwork:

  • Is eligible for copyright or other intellectual-property protection;
  • Is original or unique;
  • Does not resemble third-party content;
  • Does not contain hidden or unintended elements;
  • Is suitable for trademark registration;
  • Complies with the terms of the tool used to create it; or
  • Is free from infringement claims.

Any intellectual-property or commercial-use questions involving AI-generated content should be reviewed with a qualified attorney.

23) Artwork Files & File Retention

Customers should retain their own original artwork and order files. PopStickerMerch is not a permanent file-storage or archival service.

We may retain uploaded artwork, proofs, production files, communications, and order records for a reasonable period for reorders, customer service, accounting, dispute resolution, legal compliance, and internal production purposes.

We do not guarantee that files will remain available after an order is completed. Files may be deleted, archived, become inaccessible, or require new setup work.

A reorder is subject to current pricing, material availability, production methods, color variation, and these Terms, even when an earlier file remains available.

24) Wholesale & Business Orders

Wholesale, reseller, business, school, nonprofit, government, and other large-volume orders may be subject to additional quotes, invoices, payment schedules, lead times, quantity tolerances, shipping arrangements, and written terms.

Unless expressly agreed otherwise:

  • Payment is due before production;
  • Quoted pricing applies only to the specified artwork, quantity, size, material, and deadline;
  • Quotes may expire after the period stated on the quote;
  • Customer-requested changes may require revised pricing and timing;
  • Exact color matching is not included;
  • The ordered quantity will be counted and verified before shipment; and
  • The customer is responsible for inspecting the order within the claim period.

If separate written terms conflict with these Terms, the separate written terms control only for the specific order they address.

25) Payment Disputes & Chargebacks

Customers should contact us first if they believe there is a billing, fulfillment, or product issue so we have an opportunity to investigate and resolve it.

Initiating a chargeback does not cancel these Terms or eliminate the customer’s responsibility for properly authorized and fulfilled charges.

If a payment dispute is submitted, we may provide the payment processor, card issuer, bank, platform, insurer, collection provider, or other authorized party with relevant records, including:

  • Order and payment information;
  • Customer communications;
  • Uploaded artwork;
  • Proofs and proof approvals;
  • Production records and photographs;
  • Shipping labels, tracking, and delivery records;
  • Website policies accepted at checkout; and
  • Other information relevant to the dispute.

Fraudulent payment activity, unauthorized use of payment information, or abusive chargeback conduct may result in cancellation of pending orders, refusal of future service, collection activity, or other lawful action.

26) Website Use & Prohibited Activities

You agree not to:

  • Use our website or services for unlawful activity;
  • Violate another person’s intellectual-property, privacy, or other rights;
  • Submit false, deceptive, fraudulent, or misleading information;
  • Impersonate another person, business, or organization;
  • Attempt to bypass site security or gain unauthorized access;
  • Interfere with checkout, payment, hosting, or website operations;
  • Upload malicious code, viruses, or harmful content;
  • Scrape, crawl, harvest, index, or copy site content without permission;
  • Use automated systems to abuse promotions, inventory, forms, or checkout;
  • Resell access to our website or services;
  • Harass, threaten, or abuse our employees, contractors, customers, or representatives; or
  • Use our website content or original artwork to train an artificial-intelligence system without written permission.

27) Third-Party Services

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, review platforms, social-media services, analytics providers, and other applications.

Third-party services are governed by their own terms and privacy policies. PopStickerMerch does not control and is not responsible for the availability, accuracy, security, policies, content, or conduct of independent third-party services.

28) Disclaimers

To the fullest extent permitted by law, our website, content, products, and services are provided on an “as available” and “as is” basis, subject to any express product commitments stated in these Terms.

We do not guarantee that:

  • The website will always be uninterrupted, secure, or error-free;
  • Every product will remain available;
  • Every color will appear exactly as displayed on a screen;
  • A product will adhere to every possible surface;
  • A product will be suitable for every intended use;
  • Carrier delivery estimates will be met;
  • Use of our products will produce a particular commercial result; or
  • Customer-supplied content is legally authorized or noninfringing.

To the fullest extent permitted by law, we disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

29) Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PopStickerMerch LLC and its owners, members, employees, contractors, agents, service providers, and representatives from claims, demands, proceedings, losses, liabilities, damages, judgments, settlements, penalties, costs, and reasonable attorneys’ fees arising from or related to:

  • Content or artwork you submit;
  • Our production of products according to your instructions;
  • Your actual or alleged infringement of a third party’s rights;
  • Your violation of law;
  • Your misuse of our website, products, or services;
  • Your breach of these Terms; or
  • False or inaccurate representations made by you.

This provision does not require a consumer to indemnify PopStickerMerch for claims caused solely by PopStickerMerch’s own unlawful conduct where such an obligation is prohibited by law.

30) Limitation of Liability

To the fullest extent permitted by law, PopStickerMerch will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost sales, lost business opportunities, lost data, reputational harm, replacement labor, or business interruption, arising from or related to our website, products, services, production, shipping, or these Terms.

To the fullest extent permitted by law, PopStickerMerch’s total aggregate liability for a claim arising from or relating to an order will not exceed the amount actually paid to PopStickerMerch for the specific product or order giving rise to the claim.

PopStickerMerch is not responsible for the cost of:

  • Applying or installing products;
  • Removing products;
  • Replacing customer property;
  • Lost business, advertising, events, or promotions;
  • Customer labor or contractor charges;
  • Third-party penalties or claims;
  • Reprinting materials not purchased from us; or
  • Consequences arising from customer-approved content.

Some jurisdictions do not permit certain liability limitations. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

31) Events Outside Our Control

PopStickerMerch is not responsible for delays, interruptions, nonperformance, or increased costs caused by events reasonably outside our control, including:

  • Severe weather, hurricanes, floods, fires, or natural disasters;
  • Power, internet, software, or telecommunications outages;
  • Equipment failure or emergency maintenance;
  • Supplier shortages or material discontinuation;
  • Carrier delays, strikes, embargoes, or transportation disruptions;
  • Labor disputes or staffing emergencies;
  • Cyberattacks, malware, fraud, or security incidents;
  • Government orders, legal restrictions, customs actions, or emergencies;
  • War, terrorism, civil unrest, epidemics, or pandemics; or
  • Other circumstances that could not reasonably be prevented.

When reasonably possible, we will communicate material delays and may adjust production schedules, substitute comparable materials with customer approval when appropriate, or cancel and refund the uncompleted portion of an affected order.

32) Refusal or Termination of Service

We may refuse, limit, suspend, or terminate access to our website or services when reasonably necessary to:

  • Enforce these Terms;
  • Protect our company, customers, employees, or service providers;
  • Prevent fraud, abuse, harassment, or unlawful activity;
  • Respond to intellectual-property or legal concerns;
  • Address nonpayment or disputed charges;
  • Comply with legal requirements; or
  • Decline work we cannot safely or appropriately perform.

Provisions concerning payment, intellectual property, customer representations, indemnification, disclaimers, liability, disputes, and other provisions that logically should continue will survive completion, cancellation, or termination of an order.

33) Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, services, policies, technology, or legal obligations.

Updated Terms become effective when posted on this page unless a different effective date is stated.

The Terms in effect when an order is placed generally govern that order, except where a later change is required by law or separately accepted by the parties.

Continued use of our website after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

34) Governing Law

These Terms and any dispute arising from or relating to them, our website, or our products and services are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising from or relating to these Terms or our services must be brought in a court of competent jurisdiction located in New Jersey, and each party consents to the jurisdiction of those courts.

Nothing in this section eliminates consumer rights or venue protections that cannot legally be waived.

35) General Legal Provisions

Entire agreement

These Terms, together with the applicable product listing, accepted quote, invoice, proof, privacy policy, refund policy, and any separate written agreement, constitute the entire agreement between you and PopStickerMerch regarding the applicable transaction.

Order of priority

If a separate written agreement signed or expressly accepted by PopStickerMerch conflicts with these Terms, the separate agreement controls only for the specific transaction it addresses.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted or modified as narrowly as necessary, and the remaining provisions will remain in effect.

No waiver

Our decision not to enforce a provision on one occasion does not waive our right to enforce it later. A waiver is effective only if made in writing by an authorized representative of PopStickerMerch.

No assignment by customer

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, sale, reorganization, transfer of assets, or similar business transaction.

Electronic communications

You agree that electronic communications, including order confirmations, invoices, proofs, approvals, notices, and policy updates, satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

Headings

Section headings are provided for convenience and do not limit the meaning of these Terms.

Interpretation

Words such as “including” and “includes” mean “including without limitation.” References to writing include email and other documented electronic communications.
